29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: a) On or about 7/23/13, at Trader Joe's Store under construction at 1565 Niagara Falls Blvd., Amherst, NY: Employee was exposed to a fall of up to 14 ft. when an extension ladder was used to access the roof of the narrow canopy on the west side of the building. The siderails of the ladder only extended 29 inches above the roof. b) On or about 7/23/13, at Trader Joe's Store under construction at 1565 Niagara Falls Blvd., Amherst, NY: Employee was exposed to a fall of up to 14 ft. when an extension ladder was used to access the second level of a scaffold platform erected on the west side of the building. The siderails of the ladder only extended approx. 29 inches above the platform. NO ABATEMENT CERTIFICATION REQUIRED

WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 898191, CITATION NO. 2, ITEM NO. 1, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 04/30/2013, WITH RESPECT TO A WORKPLACE LOCATED AT THE SOUTHGATE PLAZA, 952 UNION ROAD, WEST SENECA, NY 14224; AND IN OSHA INSPECTION NUMBER 314102146, CITATION NO. 1, ITEM NO. 1, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 03/22/2010, WITH RESPECT TO A WORKPLACE LOCATED AT MOUNT READ BOULEVARD, ROCHESTER, NY 14615; AND IN OSHA INSPECTION NUMBER 313843344, CITATION NO. 1, ITEM NO. 2, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 11/20/2009, WITH RESPECT TO A WORKPLACE LOCATED AT 495 SKINNERSVILLE ROAD, AMHERST, NY 14260. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 7/23/13, at Trader Joe's Store under construction at 1565 Niagara Falls Blvd., Amherst, NY: Two employees engaged in masonry work were exposed to a potential fall of approx. 14 ft. while working and walking back & forth on the roof of a narrow canopy on the west side of the building. One of the employees was wearing a full body harness with a lanyard, but the lanyard was not attached to an anchor point. The other employee was not wearing a harness. No guardrails or other fall protection system was being utilized to protect the employee. NO ABATEMENT CERTIFICATION REQUIRED
