29 CFR 1910.132(d): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which would have necessitated the use of personal protective equipment: (a) During the raking of the still process on the perc machine at 700 South Osprey Avenue, Sarasota, FL 34236 on or about 07-31-2013 no protective gear assessment was conducted. Tetrachloroethylene (Perchloroethylene) is a central nervous system depressant and can enter the body through respiratory or dermal exposure. No protective gear was worn by the employee cleaning out the still.

29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment: (a) During the raking of the still process on the perc machine at 700 South Osprey Avenue, Sarasota, FL 34236 on or about 07-31-2013 no protective eye gear was required by the employer. Raking of the still and disposing of the still have are a potential splash hazards. Tetrachlorethylene (Perchlroethylene) can cause severe eye irritation.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes: (a) During the raking of the still process on the perc machine at 700 South Osprey Avenue, Sarasota, FL 34236 on or about 07-31-2013 no protective gloves were required to be worn by the employee conducting the raking. When raking the still manually and disposing of the still it creates a potential contact hazard. Perchloroethylene is a central nervous system depressant and can enter the body through respiratory or dermal exposure.
