29 CFR 1926.451(g)(1)(vii): Each employee is not protected by a personal fall arrest system or guard rail system, while working from a scaffold. On or about July 18, 2013, the employer did not ensure that employee working on a scaffold was protected by the use of a guardrail system or other adequate protection when working more than 10 feet above ground. This condition exposed employee to potential fall and struck-by hazards.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize the hazards. On or about July 18, 2013, employer did not ensure that each employee working from a scaffold was trained by qualified person. Employee was exposed to the hazard of falling from an elevation exceding 10 feet.
