29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: On or about July 23, 2013, and times prior thereto, the employer did not ensure all open-sided platform 4 feet or more above adjacent floor was completely guarded by a standard railing on all open sides except where there is entrance to a ramp, stairway, or fixed ladder exposing employees to a fall hazard greater than four (4) feet to the ground below. Instance a: On the 4th Floor of Elevator C the Outside Railings measured approximately 37 inches at the top rail and 18 inches at the mid rail exposing employees to a fall hazard of 145 feet to the ground below. Instance b: On the 6th Floor of Elevator C the open sided platform was not completely guarded exposing employees to fall hazards of approximately 12 feet to the concrete floor below. Instance c: The Bin Deck of Elevator H was not equipped with standard railing where employees would exit the elevator to an emergency escape ladder in the event of an emergency, exposing employees to a fall hazard up to approximately 145 feet to the ground below.
