OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:       On or about July 24th 2013, and at times prior, employees were exposed to crushing and struck-by injuries in that:      a) At least two of the fifteen auto lifts at the facility had malfunctioning swing arm locks.         Lift # 6 in the main shop area had worn out teeth on the thread rod of the right swing arm locking mechanism.       Lift # 11 in the north shop area had broken springs on the left swing arm locking mechanism.                Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service and an employee was using it before repairs and tests necessary to render the equipment safe were made:   a) On or about July 24th 2013, and at times prior, employer did not remove from service a NU-STAR's "power pusher" machine and employees continued to use the device before repairs were made to render the equipment safe. The electrical cord to the machine showed damage to the outer insulation at the plug, and half way between the plug and the device.       Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
