29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross-braces were used as a means of access: (a) Jobsite, 3822 Butler Street, Pittsburgh, PA: On or about 07/24/13 no access was provided from the uppermost level of the scaffold to other levels. Employees climbed the scaffold frame and cross-braces to access the level below where they climbed through a window into the building for access/egress from the work area. The potential fall hazard while climbing the scaffold was approximately 30 feet to the ground below.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: (a) Jobsite, 3822 Butler Street, Pittsburgh, PA: On or about 07/24/13 the employer had not provided training to the employees who work on the scaffold to recognize the hazards associated with the type of scaffold being used and the procedures and methods to control those hazards. Employees were working on the scaffold without adequate fall protection in place or a means of access between the levels.
