29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee: (as referenced in 1926.103)       On or about July 17, 2013, employees performing masonry activities were exposed to respiratory hazards.     a) An employee operated a DeWalt circular saw to cut bricks without a respirator.     b) An employee operated a DeWalt handheld grinder to cut stone without a respirator.

On or about July 17, 2013, employees performing masonry activities were cutting brinks and stone without eye and face protection exposing the employees to eye and face hazards.      a) An employee operated a DeWalt circular saw to cut bricks.   b) An employee operated a DeWalt handheld grinder to cut stone.

29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:     On or about July 17, 2013 employees performing masonry activities were operating a circular saw with the guard tied back to the handle rendering the guard inoperable. The employees were exposed to to amputation hazards.
