29 CFR 1910.132(d)(1):   The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:     a/ Bracha, Inc./Elizabeth NJ Site   Laundry/dietary:  Gloves provided by the employer for use (including but not limited) the Laundry/Kitchen cleaning operation(s) were not selected based on the specific hazard(s) employees could be exposed to.  Multi-purpose latex gloves   1/ were used when handling chemicals (including but not limited to)  "Ecolab" Laundry/Dietary products for cleaning purposes   2/ were used when handling soiled laundry where biohazard conditions could exist.      A documented hazard assessment for personal protective equipment was not provided to include all areas of the site where personal protectors may be required.  Documentation to include but not limited to specific protectors to be used, designated area of use and when to use, employee training on use, date of training and person providing training.     Observed on/or about 7/24/2013.

29 CFR 1910.335(a)(1)(i):  Employees working in areas where there were potential electrical hazards were not provided with electrical protective equipment that was appropriate for the specific parts of the body that needed to be protected and for the work being performed:       a/ Bracha, Inc./Elizabeth NJ Site  Facility/Maintenance Areas: Where employees are required (on a limited basis) to perform live electrical testing and/or trouble-shooting on machinery/equipment, protectors including but not limited to approved electrical gloves (ANSI rated 250 volts minimum and/or ANSI rated 00 or 01 - minimum 500 volts), insulated tools, etc. were not provided.  Gloves provided by the employer were not rated for electrical hazards.    Observed on/or about 7/24/2013.

29 CFR 1910.1030(d)(4)(i):  The employer did shall ensure that the work place was maintained in a clean and sanitary condition:   a/ Bracha, Inc./Elizabeth NJ Site   First Floor Laundry (Chute Room):  The floor in front of the Chute was not maintained free of soiled laundry items from site residents.  The items consisted of wet face/wash cloths, bed clothing and a couple of clear plastic bags of the same type of items.    Observed on/or about 7/24/2013.

29 CFR 1910.1030(d)(4)(iv)(A)(2):  Contaminated laundry was not placed and/or transported in bags or containers which were labeled or color-coded in accordance with 29 CFR 1910.1030(g)(1)(i):    a/ Bracha, Inc./Elizabeth NJ Site:   1/ First Floor Laundry Chute Room/Resident Area  2/ Second Floor Resident Area  Contaminated laundry was placed in clear plastic bags with no markings to indicate the contents may be contaminated.   Markings/labels to include but not limited to one or more of the following:  A Bio-hazard label, a bio-hazard symbol, an orange or orange-red label, and/or red bags or red containers may be substituted for labels.    On/or about 7/24/2013.
