29 CFR 1926.602(c)(1)(vi): All industrial trucks in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks; the load engaging means was not fully lowered when leaving a powered industrial truck unattended:    (a) 50 Block of Colin Court, Reading, Pennsylvania - The employer, who operated the telehandler, elevated a stack of wood sheathing to the top of the first floor framing, 9 feet above the ground.  The employer dismounted the telehandler and went up onto the joists and the top plates of the wood framing to help install the second floor deck using the wood sheathing.  The employer left the forks of the telehandler raised, exposing employees to the hazard of a dropped load, on or about July 26, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it was infeasible or created a greater hazard to use these systems and develop and implement a fall protection plan which met the requirements of paragraph (k) of section 1926.502:    (a) 50 Block of Colin Court, Reading, Pennsylvania - Employees stood on the joists and top plates of the wood framing of the two-story townhomes under construction while the employees installed the wood decking for the second floors of these townhomes.  The employees worked 9 feet above the ground and did not use conventional fall protection (i.e., guardrail systems, safety net systems, personal fall arrest systems) or an alternative fall protection measure under another provision of paragraph 1926.501(b).  The employer also did not demonstrate that it was infeasible or that it created a greater hazard to use conventional fall protection and develop and implement a fall protection plan, exposing employees to a fall hazard, on or about July 26, 2013.    TWIN COUNTY BUILDERS, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION STANDARD OR ITS EQUIVALENT STANDARD 1926.501(b)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 312974504, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JUNE 20, 2009, WITH RESPECT TO A WORKPLACE LOCATED AT 1220 WEST STREET ROAD, WARMINSTER, PENNSYLVANIA  18974.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
