29 CFR 1926.20(b)(2): The employer did not initiate and maintain a program of frequent and regular inspections made by competent persons at the jobsite: a) The employer did not provide sufficient safety inspection before working on the 3fl concrete deck. The employer was operating a concrete trowel machine when the deck did not have a sufficient guardrail system and when employees of other trades were working below in the stairshaft. Location: 251 Columbia St, Brooklyn N.Y. On or about 7/18/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(c): The employer did not ensure that when employees were exposed to falling objects: In addition to having employees wear hardhats, the employer shall implement one of the measures outlined in 501(c)(1) through (c)(3) which include: Provide a toeboard, or screen or the equivalent, or a canopy, or keep objects back away from the edge, or barricade the area to which objects can fall: a) Employees were exposed to being struck by falling equipment. The gas powered concrete trowel (helicopter trowel) was being operated at the edge of the 3fl concrete deck when employees were working below in the stair shaft. The guardrail around the stair shaft (floor opening) had a top rail but no midrail or toeboard and the machine fell off the edge. Location: 251 Columbia St, Brooklyn N.Y. On or about 7/18/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

CFR 1926.502(b)(13): The employer did not ensure that: When guardrails systems are used around holes which are used as points of access (such as ladderways), they shall be provided with a gate, or be so offset that a person cannot walk directly into the hole: a) At the 3fl concrete deck: At the elevator shaft there was a gap in the guardrail where a ladder was placed. There was no gate or offset rail. Employees can fall 12 feet at the 15 inch wide gap. Location: 251 Columbia St, Brooklyn N.Y.
