29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared: a. Recycle Department - On or about August 2, 2013, Employees, who were shredding poly-styrene waste and were exposed to continuous noise at 76.9% of the exposure level of 90 dBA or an eight hour time weighted average (TWA) noise exposure of 88.2 dBA. This exposure was observed occurring over a 473 minute sampling period on 3/27/13. A zero exposure was assumed for the 7 minutes not sampled. The employer did not provide a baseline audiogram.

Recycle Department - On or about August 2, 2013, Employees, who were shredding poly-styrene waste and were exposed to continuous noise at 76.9% of the exposure level of 90 dBA or an eight hour time weighted average (TWA) noise exposure of 88.2 dBA. This exposure was observed occurring over a 473 minute sampling period on 3/27/13. A zero exposure was assumed for the 7 minutes not sampled. The employer did not provide annual audiograms. b. Thermo-former Department - On or about October 24, 2013, Employees, who were removing and packaging product from the Trim Press were exposed to continuous noise at 98.7% of the reduced Action Level of 82.9 dBA or a time weighted average (TWA) noise exposure of 89.9 dBA. This exposure was observed occurring over a 649 minute sampling period on 10/24/13. The employer did not provide annual audiograms. c. Thermo-former Department - On or about October 24, 2013, Employees, who were removing and packaging product from the Trim Press were exposed to continuous noise at 98.3% of the reduced Action Level of 82.9 dBA or a time weighted average (TWA) noise exposure of 89.9 dBA. This exposure was observed occurring over a 649 minute sampling period on 10/24/13. The employer did not provide annual audiograms.
