29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a) Employees performing roofing work from a steep pitched roof were exposed to the hazard of free falling more than 6 feet and contacting a lower level while using personal fall arrest systems that were not rigged to prevent these hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Employees were exposed to the hazard of falling while engaged in roofing work without the use of fall protection. Apex Exteriors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 315220194, citation 1, item 1, and was affirmed as a final order on March 23, 2011, with respect to a worksite located at 533 Brainerd, Libertyville, Illinois. Apex Exteriors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 314735648, citation 1, item 3, and was affirmed as a final order on October 21, 2010, with respect to a worksite located at 2408 Ridgeway, Evanston, Illinois. Apex Exteriors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 314686171, citation 1, item 2, and was affirmed as a final order on September 3, 2010, with respect to a worksite located at 115 Dover Drive, Des Plaines, Illinois.
