29 CFR 1910.1030(e)(3)(ii): The employer did not ensure that employees used appropriate personal protective equipment:           a) On or about July 22, 2013, in the SPD Department, employees were required to work with disposable (single use) gloves during the initial sorting of reusable surgical equipment. Disposable (single use) gloves were not appropriate for the initial sorting of equipment. The employees were thereby exposed to hazards associated with contaminated sharps.

29 CFR 1910.1030(c)(1)(v): The employer, who was required to establish an Exposure Control Plan did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation, and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control Plan:  a) On or about July 22, 2013, at the above located workplace, employees experienced approximately 45 sharps injuries in 2012 and 12 sharps injuries in 2013. The employer did not document the solicitation of input from non-managerial employees responsible for direct patient care in the identification, evaluation, and selection of effective engineering and work practice controls.

29 CFR 1910.1030(h)(5)(i):  The employer did not establish and maintain a sharps injury log for the recording of percutaneous injurers from contaminated sharps. The information in the sharps injury log was not maintained in such a manner as to protect the confidentiality of the injured employee. The sharps injury log did not contain at a minimum:   A) The type and brand of device involved in the incident.  B) The department or work area where the exposure occurred, and  C) An explanation of how the incident occurred:    a) During the period of March 22, 2013 though July 22, 2013, at the above located workplace, employees experienced sharps injuries. The employer's sharps injury log did not include the type and brand of device. The lack of information about the type and brand of needle involved in the incident prevented a determination of the effectiveness of the needle's safety features.
