29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: On May 21, 2013 and at times prior thereto; maintenance shop; employee was using a surge/power strips, next to a water source, to provide power to equipment such as but not limited to computer during an abatement job. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection a) On May 21, 2013 and at times prior thereto; near containment, employee was using portable electrical equipment near a water source that was not protected with a ground fault circuit interrupter that would protect them from electrical shock in the event that the equipment became damaged or compromised. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
