OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to hazards associated with the improper operation of forklift boom attachments: 250 and 240 buildings, Hyster S50XM with Abaco AFJS-25 swing arm forklift boom, Mitsubishi FGC30 with Vestil LM-1T-6 lift master boom: On or about July 30, 2013, employees were exposed to crushed-by or struck-by hazards when handling granite and marble slabs using fork lift boom attachments in an inappropriate manner as follows: 1. The safety chains designed by the manufacturers to lock the boom lift attachments to the fork lift carriages or towers were not used. Without such safety chain locks in place, the boom lift attachments and any associated loads of granite and marble slabs could have slid off the forks and caused an injury. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

Lift trucks' boom attachments being used were not marked to identify them on the lift trucks and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered. There is no abatement certification or documentation required for this item.
