OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from climbing job-made ladder for framing a two story residence located at or near 14400 Bethel Blacktop Road in Farmington, Arkansas.  Employees were using wooden job-made ladders without filler blocks inserted between the rungs to support the cleats, exposing employees to fall hazards during use.  Among other methods, one feasible and acceptable method to abate the hazardous condition would be to construct the ladder in accordance with American National Standards Institute (ANSI) A14.4-1992, section 4.5.2.

Employees had used site-constructed ladder constructed of 2x4 lumbar for securing framing. An employee performing work on a site constructed scaffold near the second story rooftop had fell approximately a distance of greater than 20 feet to the concrete ground level below which resulted in serious injuries.  The employer had not made any provisions prior to the commencement of the project for prompt medical attention, which resulted in no medical attention being provided to an employee suffering serious injuries at the worksite.

An employee performing work on a site constructed scaffold near the second story rooftop had fell a distance of greater than approximately 20 feet to the concrete ground level below which resulted in serious injuries.  The nearest dispatch location for emergency medical services was approximately 7.5 miles from the location and greater than 3-4 minutes to the worksite.  The employer did not have a person with a valid certificate in first-aid training available at the worksite to render first-aid.
