29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program those provisions, as applicable, of this section outlined in 1910.134 (c)(1)(i) through (ix): Worksite: When then employer supplied half-mask elastomeric respirators to employees as protection against silica-containing dust, the employer did not develop and implement a written respiratory protection program with site-specific procedures for employees to follow that would protect their health.

29 CFR 1910.134(d)(1)(i): The employer did not select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker was exposed and workplace and user factors that affect respirator performance and reliability: Worksite: When employees were issued, and wore, half-mask elastomeric respirators as protection against silica-containing dust, the employer did not supply the correct cartridges for the hazard encountered. The cartridges used by employees used by the employees with these respirators were effective against solvent vapors, not silica-containing dusts.

29 CFR 1910.134(g)(1)(i): The employer permitted respirators with tight-fitting facepieces to be worn by employees who have: (A): Facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function: Worksite: The employer allowed employees with interfering facial hair to wear half-mask elastomeric respirators for protection against silica-containing dusts. This facial hair can adversely affect respirator fit, reducing the effectiveness of the respirator's protection.
