29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  A). On or about 07/29/13, in the front of 252-17 Northern Blvd. Little Neck, NY  An employee working in the trench approximately (3' x 5' x 5' deep)was in danger of head injury from falling objects such as, but not limited to tools and soil from edge of the trench. Protective helmet was not worn.  ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.   A).      on or about 07/29/13, in the front of 252-17 Northern Blvd. Little Neck, NY     Soil were placed by the edge of the excavation approximately 3 ft.  x 5 ft. x 5 ft. in depth. An employee disconnecting water pipe in an unprotected excavation was exposed to the hazard of cave-in.    ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
