29 CFR 1910.23(c)(1): Open-sided platforms and runways 4 feet or more above adjacent floor or ground level were not guarded by a standard railing on all open sides except where there is entrance to a ramp, stairway, or fixed ladder: a) 3128 New Castle Ave., New Castle, DE - Fill-up Station - Employees were exposed to fall hazards over 10 feet above the ground while standing on the platform at the Off-Road diesel fill-up station. The exterior (South) side of the platform was not guarded by standard railing. This exposed the employees to fall hazards as they filled the fuel storage tanks. The violation was observed on or about July 31, 2013. b) 3128 New Castle Ave., New Castle, DE - Fuel Storage Tanks - Employees were exposed to fall hazards over 10 feet above the ground while standing on the runway at the diesel storage tanks. The exterior (West) side of the platform/walkway was damaged and not guarded by standard railing. This exposed the employees to fall hazards as they access the tanks daily to measure capacity. The violation was observed on or about July 31, 2013.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not removed from service: a) 3128 New Castle Ave., New Castle, DE - Employees used a CAT forklift Model: CGP-40, Type: G, Serial: CGP4600-0028-9492FB, that was not in safe operating condition, throughout the site. The truck had damaged tires, lighting, lack of seatbelt, lifting issues, and it was not removed from service. This exposed the employees to potential injuries due to the unsafe condition and possible equipment failure. The violation was observed on or about July 31, 2013.

The employees use the equipment on a daily basis throughout the site. This exposed the employees to potential injuries from improper use. The violation was observed on or about July 31, 2013.
