29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about July 31, 2013 at the worksite; employees were using pneumatic nailers to secure roofing shingles and not wearing eye protection.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. a) On or about July 31, 2013 at the worksite; employees were working on an approximately 19.7 ft. high 10/12 pitch roof with no conventional fall protection measures being used. The employees were caulking the new flashing. b) On or about July 31, 2013 at the worksite; employees were working on an approximately 8.9 ft. high 8/12 pitch roof with no conventional fall protection measures being used. The employees were installing new roof shingles.
