29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:    (a)  Sanding Operations:  On July 31, 2013 and at times prior thereto, a North 7700 half face respirator equipped with North N7500-3 cartridges was who worn while sanding vehicles which produces airborne particles.  The N7500-3 cartridges are designed to provide protection for exposures to Organic Vapor, Chlorine, Hydrogen Chloride, Sulfur Dioxide, Hydrogen Fluoride and Chlorine Dioxide but not particles.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   (a) Sanding Operations:  On July 31, 2013 and at times prior thereto, employees who voluntarily wore tight fitting respirators, including a North 7700 half face respirator and a 3M half-face respirator, while sanding vehicles were not medically evaluated prior to wearing the respirators.     (b)  Painting Operations:  On July 31, 2013 and at times prior thereto, employees who were required to wear an air-supplied SATA 51854 respirator hood while painting in the spray booth were not medically evaluated prior to wearing the respirator.
