Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The  employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working in an 8 story, unsprinklered air traffic control tower (ATCT) were exposed to hazards related to fire and smoke:    (a) Location - South wall, utility chase, 1st floor through 7th floor:  On or about 07/19/13, the agency did not ensure that fire barriers, fire stopping and smoke barriers were adequately installed for floor penetrations in ATCT Building 131, as required by NFPA 101.  Utility chase floor penetrations for comunication cable, electrical wiring conduit, and PVC pipe sleeves were inadequately fire stopped nor separated by a shaft enclosure designed as a fire barrier to prevent the spread of fire and smoke.    (b) Location - Cab floor; penetrations from 7th floor ceiling:  On or about 07/19/13, floor openings and penetrations into the cab for communication cable, electrical raceways, plumbing piping were not protected by fire stopping and smoke barriers to prevent spread of fire and smoke.    (c) Location - East corner of exit stairway; 1st floor through 6th floor:  On or about 07/19/13, a plumbing waste and water piping chase in the exit stairway was not separated by a 2 hour fire barrier to prevent the spread of fire and smoke.

29 CFR 1910.36(a)(2): An exit was not separated by fire resistant materials. Construction materials used to separate an exit from other parts of the workplace did not have a one-hour fire resistance-rating if the exit connects three or fewer stories and a two-hour fire resistance-rating if the exit connects four or more stories.    (a) Location - Building 131; ATCT Exit Stairway:  On or about 07/19/13, a pipe chase penetrating landings on stairway floors 1 - 6, was enclosed by 3/8" plywood sheeting which did not have at least a 2 hour fire resistant rating, exposing employees to potential hazards related to fire and smoke.     (b) Location-  Building 131; ATCT Exit Stairway: throughout the stair enclosure HVAC piping, duct work, HVAC ducts, and PVC plumbing, was not separated from the exit stair enclosure or enclosed with separation construction rated with 2 hour fire resistance materials, exposing employees to potential hazards related to fire and smoke.
