29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures:     (a) On or about 12/03/2013, at body shop, for employee painting vehicles and parts in the spray paint booth while wearing a 3M Powered Air Purifying Respirator with organic vapor/high efficiency cartridge respiratory protection system, or 3M Model 7192/7193 half-facepiece respirator with organic vapor cartridges.    (b) On or about 12/03/2013, at body shop, for employees in the shop areas who wore 3M Model Number 07048, N95, disposable particulate respirator while prepping vehicles or parts.

29 CFR 1910.141(g)(2): Employees were allowed to consume food or beverages in a toilet room and/or in any area exposed to a toxic material:    (a) On or about 12/03/2013, in establishment's paint mixing room, for employee mixing paints and working in the paint mix room. Employee consumed water from a plastic bottle while in this room. Safety data sheets of the paints and solvent used in this room indicated that toxic chemicals are present. Some of the toxic chemicals found during the sampling event included low levels of: isocyanate compounds;  n-butyl acetate; ethyl benzene; xylene; acetone; heptane; tri-methyl benzene; and toluene.

29 CFR 1910.141(g)(4): Food or beverages were stored in toilet rooms or in an area exposed to a toxic material:  (a) On or about 12/03/2013, in establishment's paint mixing room, for employees that paint and perform auto body work. A refrigerator in the paint mixing room contained employee lunches and beverages. Some of the toxic chemicals found in the mixing room air during the sampling event included: isocyanate compounds; n-butyl acetate; ethyl benzene; xylene; acetone; heptane; tri-methyl benzene; and toluene.

29 CFR 1910.1200(e)(1): Employer did not develop, implement, and maintain at the workplace, a written hazard communication program, which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    (1) A list of the hazardous chemicals known to be pesent using an identify that is referenced on the appropriate safety data sheet;  (2) The methods the employer will use to inform employees of the hazards of non-routine tasks, and the hazards associated with chemicals contained in unlabeled pipes in their work areas; and  (3) For multi-employer workplaces, how hazards of chemicals being used will be communicated between employers and employees.    (a) On or about 07/31/2013, at establishment, for employees using hazardous chemicals while working in the mixing room, spray paint booth and other shop areas. Review of safety data sheets for raw materials being used indicated that hazardous materials including, but not limited to, acetone, heptane, toluene, n-butyl acetate, ethyl benzene, xylene and tri-methyl benzene are being used.

29 CFR 1910.1200(f)(5): Except as provided in paragraphs (f)(6) and (f)(7) of this section, the employer did not ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with the identity of the hazardous chemicals contained therein and appropriate hazard warnings, or alternatively, words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemicals:  (a) On or about 07/31/2013, at establishment, for employees using, or in the immediate area of, unlabelled containers of hazardous chemicals. Compliance officer observed a 5-gallon, unlabelled container of acetone and approximately a 16-gallon unlabeled container of lacquer thinner. These materials are classified as flammable or combustible liquids.
