29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  (a) Shoulder of northbound lanes of S.R. 61, approximately two (2) miles north of Port Clinton, PA: Employees were working in a trench with the excavated material (soil/rocks) directly abutting the west sidewall of the trench. Employees were exposed to struck-by and caught-in hazards from excavated materials that could fall or roll into the trench, as observed on or about August 5, 2013.  In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. Abatement was observed during the inspection.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) Shoulder of northbound lanes of S.R. 61, approximately two (2) miles north of Port Clinton, PA: Employees used a six-foot (6') portable step-ladder that did not extend at least 3 feet above the ground level as the lone means of egress for a trench with depths ranging between five-foot (5') and four-foot five-inches (4'5"). Employees were exposed to a fall hazard while entering and exiting the trench, on or about August 5, 2013.  In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. Abatement was observed during the inspection.
