OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards when using defective step ladders.      (a) Processing - On or about August 1, 2013, an 8 foot step ladder and a 4 foot step ladder were defective. The 8 foot step ladder had several bent cross braces.  The 4 foot step ladder was missing a spreader.

29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    (a) Processing - On or about August 1, 2013, the sanitation employees were not wearing eye protetcion while using high pressure water hoses to wash down machinery and equipment.  The employees were exposed to eye injuries due to chicken particles blowing back into the face when cleaning machine parts with high pressure water. The employees were also at risk of eye injuries from high pressure water stream.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.     (a) Shipping - on or about August 1, 2013 the Mitsubishi forklift, DG-9, had a busted steering Column.  The steering Column was wobbly and held together with packaging tape.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    (a) Processing - On or about August 1, 2013, the vat dumpers were not properly guarded to keep employees out of the danger zones.

29 CFR 1910.305(b)(1)(i): Conductors entering cutout boxes, cabinets, or fittings shall be protected from abrasion, and openings through which conductors enter shall be effectively closed.       (a) Shipping, Forklift Battery Chargers - On or about August 1, 2013 the battery charger cables were not protected against abrasion at the location where the cables entered the charger.  The openings where the charging cables entered the battery chargers were not effectively closed.
