29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators.          (a) Front side, apartment building Q2 located at 2665 Favor Road, Marietta, GA 30060: Employees were exposed to fall hazards when the employer allowed his employees to use the TranzSporter (Model LH200) Platform Hoist as a ladder to access the roof. Manufacturer's general safety instructions state that this hoist should never be used as ladder.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Roof, apartment building Q2 located at 2665 Favor Road, Marietta, GA 30060: Employees engaged in residential roofing activities on a 4/12 pitched roof at heights of approximately 20-feet, 1-inch were not provided with a fall protection system.  Sergio Perez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 315512608, citation number 1, item number 1a and was affirmed as a final order on 08/09/2011, with respect to a workplace located at 2094 Old Cahaba Place, Helena, AL 35080.
