29 CFR 1910.36(a)(2): An exit must be separated by fire resistant materials. Construction materials used to separate an exit from other parts of the workplace must have a one-hour fire resistance-rating if the exit connects three or fewer stories and a two-hour fire resistance-rating if the exit connects four or more stories.    (a) Location - Building 131; ATCT Exit Stairway:  On or about 07/19/13, a pipe chase penetrating landings on stairway floors 1 - 6, was enclosed by 3/8" plywood sheeting, and did not have at least a 2 hour fire resistant rating.     (b) Location-  Building 131; ATCT Exit Stairway:   On or about 07/19/13, throughout the stair enclosure HVAC piping, duct work, HVAC ducts, and PVC plumbing, had not been separated from the exit stair enclosure or enclosed with separation construction rated with 2 hour fire resistance materials.

29 CFR 1910.36(a)(3): A self-closing fire door did not remain closed and did not automatically close in an emergency upon the sounding of a fire alarm or employee alarm system.  (a) Location - Building 131; ATCT Exit Stairway: On or about 07/19/13, fire doors recently installed on levels 1, 2, 4-6 which open into the exit of the ATCT, did not latch nor have self closing devices.  (b) Location - Building 131; ATCT Exit Stairway: On or about 07/19/13, the fire rated door from the ETVS Room leading to the exit on the 7th floor had been removed, and not replaced.

29 CFR 1910.37(d)(2): During repairs or alterations, employees must not occupy a workplace unless the exit routes required by this subpart are available and existing fire protections are maintained, or until alternate fire protection is furnished that provides an equivalent level of safety.    (a) Location - Building 131; ATCT Exit Stairway:  On or about 07/19/13, fire doors newly installed on levels 1, 2, 4 - 6 of the ATCT did not latch, nor have self closing devices.    (b) Location - Building 131; ATCT Exit Stairway:  On or about 07/19/13, the fire rated door from the ETVS Room leading into the exit on the 7th floor had been removed, and not replaced.    (c)  Location - Building 131; ATCT Exit Stairway:  On or about 07/19/13, window openings in the exterior walls of the exit were replaced with 1/2" plywood in lieu of fire window assemblies.

At least two exit routes were not available in the workplace to permit prompt evacuation of employees and other building occupants during an emergency, except as allowed in paragraph (b)(3) of this section.     (a) Location - Building 131; ATCT Exit Stairway:  On or about 07/31/13, the distance of travel measured from the observation cab to the exit discharge within the unsprinklered air traffic control tower, exceeded the maximum allowable limit as required by the Life Safety Code for a single means of egress.

29 CFR 1910.36(g)(1): Ceiling of an exit route was not at least seven feet six inches.  Any projection from the ceiling must not reach a point less than six feet eight inches from the floor.     (a) Location - Building 131; ATCT Exit Stairway:  On or about 07/19/13, the ceiling height of the exit on the 6th floor level had a plywood enclosure that projected down and measured 6'-1".

29 CFR 1960.8(a):  The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to hazards related to fire and smoke.     (a) Location - South wall, utility chase, 1st floor through 7th floor:  On or about 07/19/13, the agency did not ensure that fire barriers, fire stopping and smoke barriers were adequately installed for floor penetrations in ATCT Building 131.  Utility chase floor penetrations for comunication cable, electrical wiring conduit, and pvc pipe sleeves were inadequately fire stopped nor separated by a shaft enclosure designed as a fire barrier to prevent the spread of fire and smoke.    (b) Location - Cab floor; penetrations from 7th flloor ceiling:  On or about 07/19/13, floor openings and penetrations into the cab for communication cable, electrical raceways, plumbing piping were not protected by fire stopping and smoke barriers to prevent spread of fire and smoke.    (c) Location - East corner of exit stairway; 1st floor through 6th floor:  On or about 07/19/13, a plumbing waste and water piping chase in the exit stairway was not separated by an adequate fire barrier to prevent the spread of fire and smoke.
