Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and/or struck-by hazards:  (a) On or about July 24, 2013 and at times prior to that date, for the employees exposed to fall and/or struck-by hazards while riding in the excavator bucket of a Case CX240B hydraulic excavator as a means of entrance and egress into an excavation approximately 29 feet deep at 1810 26th Avenue SW in Jamestown, North Dakota.  Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be to follow the general safety requirements outlined in the Case CX240B Operator's Manual and the Association of Equipment Manufactures (AEM) Safety Manual for Hydraulic Excavator (HE-1004, April 2010).
