OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:     a) Residential Construction; Whitefish, MT: On August 6, 2013 and at times prior, employees were working on a wooden plank that was placed on the guardrails of an elevated platform attached to an all terrain fork lift. This exposed employees to a fall of more than 12 feet to the ground below.       Among other methods, a feasible means of abatement would be to follow the manufacturer's safety warnings and not use wooden planks or other materials to gain additional height in the platform or follow ASME B56.6-1992 for guidance on how to properly use a platform used to elevate personnel.         b) Residential Construction; Whitefish, MT: On August 6, 2013 and at times prior, employee(s) were working in an elevated platform attached to an all-terrain fork lift. The operator of the forklift was not at the controls or in a position to lower the employee(s) in the event of an emergency. This exposed employees to fall hazards of at least 12 feet to the ground below.        Among other methods, a feasible means of abatement would be to follow the manufacturer's safety warnings and ensure that there is a trained operator at the controls of the fork lift whenever anyone is elevated in the platform among other methods, or follow ASME B56.6-1992 section 5.15 for guidance on how to properly use a platform used to elevate personnel.
