29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:(a)(LOCATION)(IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)    (a)  The portable ladder being used for access to the roof did not extend at least 3 feet above the upper landing area.      The Bauer Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 280840, citation number 1, item number 1 and was affirmed as a final order on May 17, 2012, with respect to a workplace located at N42 W22792 Beascon Ct., Pewaukee, WI 53072.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)  NOTE TO CSHO: USE THIS OPTION ONLY IN CASES WHERE THE INFEASIBILITY/GREATER HAZARD EXCEPTION IS NOT IN ISSUE.    (a)  Employees conducting roofing activities on a roof with a 8:12 pitch were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 11.6 feet.      The Bauer Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 280840, citation number 2, item number 1 and was affirmed as a final order on May 17, 2012, with respect to a workplace located at N42 W22792 Beascon Ct., Pewaukee, WI 53072.
