29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary.    On or about: 08/06/2013    Location: Central Avenue and Rustlewood Avenue, Milton, MA    Employees were exposed to struck by hazards from falling debris while working in a trench where pieces of loose pavement were allowed to accumulate on the side walls of the trench.

29 CFR 1926.651(c)(2): The employer does not provide a stairway, ladder, ramp or other safe means of egress in trench excavations that are 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.    This violation was most recently observed on or about August 6, 2013 at a worksite located at Central Avenue and Rustlewood Avenue, Milton, MA where two employees were working in a 6.8 foot deep trench and a safe means of egress was not provided for every 25 feet of lateral travel.    Pursuant  to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it has taken to ensure compliance including, but not limited to, program improvements, job hazard analysis, written plans, site inspections, training and other appropriate materials/documents.

29 CFR 1926.652(a)(1):The employer does not protect each employee in an excavation from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).     This violation was most recently observed on or about August 6, 2013 at a worksite located at Rustlewood Avenue and Central Avenue, Milton, MA where employees were exposed to cave in hazards while working in a 6.8 foot deep trench where cave in protection was not used. To abate this violation, the employer must ensure that its excavations are properly sloped or equipped with support of shield systems, and that no employees enter excavations until this protection is provided.    Pursuant  to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it has taken to ensure compliance including, but not limited to, program improvements, job hazard analysis, written plans, site inspections, training and other appropriate materials/documents.
