29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Upper Roof, new residential construction located at 3036 Canton View Walk, Marietta, GA 30068: Two employees loading a 8/12 pitched roof with Timberline roofing shingles were exposed to falls of approximately 22-feet, 10-inches to the ground when no fall protection system was provided. (b) Lower Roof, new residential construction located at 3036 Canto View Walk, Marietta, GA 30068: One employee receiving shingles on a 8/12 pitched was exposed to falls of approximately 10-feet, 8-inches to the ground when no fall protection system was provided.

29 CFR 1926.552(a)(1): The employer did not comply with manufacturer's specifications and limitations applicable to the operation of all hoists and elevators. (a) Front side, new residential construction located at 3036 Canton View Walk, Marietta, GA 30068: Employer allowed an employee to use the TranzSporter (Model LH200) Platform Hoist as a ladder to access the roof. Manufacturer's general safety instructions state that this hoist should never be used as a ladder.
