OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls while working from unapproved platforms (pallets, parts tubs) affixed to the forks of a material handling lift truck.    a)  Enchanted Forest Building.  On or about August 2, 2013, maintenance employee(s) stood on a pallet on the forks of the lift truck approx. 6-8 feet high to change pieces on the Zip Line ride in front of the Enchanted Forest Building.    b)  Enchanted Forest Building.  On or about the week of July 29, 2013 maintenance employee(s) stood in a parts tub on the forks of the lift truck approx. 6-8 feet high to service one of the indoor amusement rides.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.23(a)(1): Every stairway floor opening was not guarded by a standard railing constructed in accordance with paragraph (e) of this section on all exposed sides (except at the entrance to the stairway):    Chemical Room, Stairs to Basement Level.  At the top of the stairway, there was an unguarded floor opening (approx. 12" depth by 24" width) where the stairway railings terminated in order to allow the door between the chemical room and the stairway to open inward toward the stairs.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.23(a)(10): A platform was not provided where door(s) or gate(s) opened directly on a stairway:  Chemical Room, Basement Stairway Door.  A steel door opened directly onto the stairway to the basement of the chemical room.  There was no platform.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      Grand Bear Lodge and Enchanted Forest Buildings.  Maintenance employees performed servicing and maintenance on machines or equipment with multiple energy sources such as but not limited to amusement rides, waterpark motors, and air conditioning units.  The employer did not implement and maintain a lockout/tagout program consisting of specific energy control procedures, employee training and periodic inspections as follows:       a) Procedures for the control of hazardous energy were not developed, documented and utilized by the employer.       b) Training of "Authorized", "Affected" and "Other" employees was not conducted and certified by the employer.   Employees authorized to perform lockout/tagout were not informed of and trained to control hazardous energy sources according to specific procedures.      c) Periodic inspections of the energy control procedures were not conducted and certified by the employer at least annually to ensure that the procedures and requirements of the standard were being followed.      Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    Entire Facility.  Maintenance employees operated the forklift.  The employer did not ensure that each operator had received training and a performance evaluation (driving test) in the safe operation of the vehicle.    Abatement documentation required for this item in accordance with 29 CFR 1903.19(d).
