29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the warehouse, Hyster forklift operator was exposed to a dose of 146.7% or/and equivalent dBA (decibel "A" scale) of 92.8 dBA, which is capable of causing hearing loss. The sampling was performed approximately 438 minutes during one shift on July 31, 2013. b) In the warehouse, Grader #2 operator was exposed to a dose of 69.7% or/and equivalent dBA (decibel "A" scale) of 87.4 dBA, which is capable of causing hearing loss. The sampling was performed approximately 381 minutes during one shift on July 31, 2013. c) In the Bagging area, Bagging area #1 operator was exposed to a dose of 75.35% or/and equivalent dBA (decibel "A" scale) of 87.9 dBA, which is capable of causing hearing loss. The sampling was performed approximately 384 minutes during one shift on July 30, 2013. d) In the Bagging area, Bagging area operator was exposed to a dose of 93.22% or/and equivalent dBA (decibel "A" scale) of 89.5 dBA, which is capable of causing hearing loss.
