29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks.      (a)    Rocky Mountain Pumpkin Ranch, at 1020 W. County Road 72, Wellington, CO 80549:  On and before July 19, 2013 the employer had not developed a written hazard communication program which at least described how the criteria specified for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks.  This condition exposed employees to hazards associated with chemicals such as, but not limited to, pesticides containing rodent poison and irritants.

County Road 72, Wellington, CO 80549:  On and before July 19, 2013 the employer did not ensure each container of hazardous chemicals was labeled or marked to indicate the contents.  This condition exposed the employees to the hazards associated with chemical irritants of the eyes, skin, and respiratory system.

County Road 72, Wellington, CO 80549:  On and before July 19, 2013 the employer did not maintain copies of the material safety data sheets for each hazardous chemical in the workplace, such as but not limited to these types:              (1)  Organic pesticide chemicals            (2)  Rodent poison            (3)  Operational chemicals like fuels, oils, etc.            This condition may result in employees using chemicals in an unsafe manner due to lack of knowledge about the chemicals.

29 CFR 1910.1200(h): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:    (a)    Rocky Mountain Pumpkin Ranch, at 1020 W. County Road 72, Wellington, CO 80549:  On and before July 19, 2013 t the employer did not ensure that employees received training regarding the health and safety hazards of associated with chemicals such as but not limited to pesticides and rat poison that employees are exposed to in the course of their routine job duties.  Lack of training could result in employees not protecting themselves from chemical hazards.
