29 CFR 1926.1101(g)(8)(ii)(F): Upon being lowered, unwrapped material was not transferred to a closed receptacle in such manner so as to preclude the dispersion of dust: Worksite: When the employer directed the removal of Asbestos Containing Material (ACM) using a crane and clamshell bucket, the material was not transferred to a closed receptacle in order to preclude the dispersion of dust.

29 CFR 1926.1101(g)(8)(vi): Instead of the work practices and controls listed in paragraph (g)(8)(i) through (v) of this section, when the employer used different or modified engineering and work practice controls the following provisions were not complied with: (A): The employer did not demonstrate by data representing employee exposure during the use of such method(s) under conditions which closely resemble the conditions under which the method is to be used, that employee exposure would not exceed the PELs or Excursion Levels under any anticipated circumstances; (B): A Competent Person did not evaluate the work area, the projected work practices and the engineering controls, and did not certify in writing, that the different or modified controls were adequate to reduce direct and indirect employee exposure to below the PELs under all expected conditions of use and that the method meets the requirements of this standard: Worksite: When the employer assigned a contractor to remove Asbestos-Containing Material (ACM) from a roof an exposure assessment, or equivalent data representing employee exposure, was not conducted immediately before or at the initiation of the operation to determine expected exposures to asbestos. In addition, a Competent Person did not evaluate the work area, projected work practices, and engioneering control used, and did not certify in writing that these different or modified controls were adequate to reduce direct and indirect employee exposure.
