29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) On August 5, 2013 and at times prior thereto; outside southside, Employer had an employee operating a Lull All-terrain vehicle without recieving the required practical and classroom training needed to demonstrate competency. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
