29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) On August 5, 2013 and at times prior thereto; outside southside, Employer had an employee operating a Lull All-terrain vehicle without recieving the required practical and classroom training needed to demonstrate competency.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.         For the purposes of this inspection, the employer was determined to be the controlling and correcting employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a) On August 5, 2013 and at times prior thereto; Southside exterior area; employee was not wearing eye protection to protect him from the debris that is generated by a masonry saw cutting gray concrete block.       For the purposes of this inspection, the employer was determined to be the controlling and correcting employer of the jobsite. 29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupers for personal protection.    a) On August 5, 2013 and at times prior thereto; first floor, employee was using portable electrical equipment such as but not limited to grinders/cutters that were not protected with a ground fault circuit interrupter that would protect them from electrical shock in the event that the portable tools used in the process became damaged.     For the purposes of this inspection, the employer was determined to be the controlling and correcting employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.

Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
