29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of 29 CFR 1926.501: a) Jobsite on State Street, Schenectady, NY - On or about August 8, 2013 employees were removing and installing a roof without utilizing proper fall protection. Employees were exposed to a fall hazard of approximately 31 feet from the roof peak. Alex Brothers Construction, Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number491178, citation number 01, item number 001 and was affirmed as a final order on October 30, 2012, with respect to a workplace located at Pinewoods Avenue, Troy, NY.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Jobsite in Schenectady, NY front of building - On or about August 8, 2013, an extension ladder used to access a roof was not extended at least 3 feet above the eave exposing an employee to a fall hazard of approximately 20 feet to ground level. b) Jobsite in Schenectady, NY west side of building - On or about August 8, 2013, an extension ladder used to access a roof was not extended at least 3 feet above the eave exposing an employee to a fall hazard of approximately 20 feet to ground level. Alex Brothers Construction, Corp. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 311978571, citation number 01, item number 002 and it was affirmed as final order date on July 16, 2009, with respect to a workplace located at Wilton Gansevoort Road, Gansevoort, NY 12831.
