29 CFR 1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating, or moving parts of equipment exposed to contact by the employees or which otherwise created a hazard, were not guarded: (a) On or about 08/08/13, at the RGRTA Transit center, located at 61 St. Paul Street, in Rochester, New York, a cement mixer was in use with the gear box guard in the open position exposing the operator to the drive belt and sprockets. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.150(a)(4): Firefighting equipment was not periodically inspected: (a) On or about 08/08/13, at the RGRTA Transit center, located at 61 St. Paul Street, in Rochester, New York, a portable fire extinguireesher located in the Pleasant Street parking lot had been discharged. The fire extinguisher had not been taken out of service or inspected to ensure it was in operating condition. NO ABATEMENT CERTIFICATION REQUIRED
