29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Patio roof on southwest side of building, 110 Schechter Drive, Wilkes-Barre Township, PA: Employees removed light fixtures from the southwest wall of the building without any means of fall protection while on a patio roof that ranged in height from eight-foot two-inches (8'2") to ten-foot, two-inches (10'2"). Employees were exposed to a fall hazard, on or about August 6, 2013. In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. Abatement was observed during the inspection.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support that will not deflect, with a grasping device, such as a grabrail, provided to assist employees in mounting and dismounting the ladder: (a) Patio roof on southwest side of building, 110 Schechter Drive, Wilkes-Barre Township, PA: Employees accessed a roof using a six-foot (6') portable step-ladder without a rigid support, without a grasping device, and without side rails that extended at least 3-feet above the eight-foot, two-inch (8'2") roof height. Employees were exposed to a fall hazard, on or about August 6, 2013. In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. Abatement was observed during the inspection.
