29 CFR 1910.1030(c)(1)(iv): The Exposure Control Plan was not reviewed and updated when necessary to reflect new or modified tasks and procedures which affect occupational exposure and to reflect new or revised employee positions with occupational exposure:    On or about August 12, 2013 the employer at the above addressed jobsite, did not update the exposure control plan to include a new employee position: physician assistants, who currently perform procedures such as, but not limited to biopsies, that have occupational exposure to bloodborne pathogens.

29 CFR 1910.1030(c)(1)(iv)(B): The review and update of the exposure control plan did not document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure:  On or about August 12, 2013 the employer did not document annual consideration and implementation for safer scalpels to be used by employees who perform procedures, such as but not limited to, biopsies. Retractable safety scalpels are commercially available and can be considered for use.

29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, did not solicit input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:  On August 12, 2013 the employer at the above addressed jobsite, did not document solicitation of employees such as, but not limited to, physician assistants input in the selection and evaluation of safety needles.

29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employees exposure:    On or about August 12, 2013, the employer did not use engineering controls, such as, but not limited, safety needles and safety scalpels, to eliminate or minimize employee exposure. Self-sheating syringes, retractable needles, and retractable scalpels, and among other controls, are commercially available and could have been used.
