29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On or about July 30, 2013 and times prior thereto, an employee of Rojelio Sanchez performed roof decking on a 12:12 pitch rooftop on a two story residence being constructed at or near 14400 Bethel Blacktop Road in Farmington, Arkansas. Mr. Sanchez was observed exposed to overhead hazards when standing on the ground level below the edge of the rooftop handing materials to the employee working on the roof. Mr. Sanchez was not wearing a hard hat and was exposed to struck-by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about July 30, 2013 and times prior thereto, an employee of Rojelio Sanchez was observed performing decking on a rooftop on a two story residence being constructed at or near 14400 Bethel Blacktop Road in Farmington, Arkansas. The employee had been observed walking on a 12:12 pitch rooftop obtaining materials and walking up the peak of the roof to perform decking without the use of fall protection. The employee had been exposed to fall distances of greater than 6 feet to the ground level below.

The employee was performing work on the 12:12 pitch rooftop without the use of fall protection and was exposed to fall distances of greater than 6 feet to the ground level below. The employer had not provided a training program for the employee exposed to fall hazards to enable hazard recognition and procedures to follow to minimize hazards.
