OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a struck-by hazard while operating a combine with a faulty emergency brake   a) On or about August 5, 2013, and at times prior thereto, an employee attempted to disengage a stuck parking brake on a John Deere Turbo 770 combine with a hammer while he was lying on the ground behind the tire. The combine was in neutral  gear and parked on a slight slope. When the brake released the combine rolled back and the employee was crushed.   NOTE: Abatement certification and documentation ARE required for this item.
