OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  On or about 8/7/2013, at the Pendergrass facility, employees were exposed to struck by hazards as the employer was not following standards set forth in ANSI MH16.1, 2008 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks for metal shelving systems used in production and shipping departments. In July 2013 a racking system failed and collapsed in the production area. The employer had not regularly inspected the racks for damage and ensured all repairs or replacements were made to the racks as needed and did not display the load ratings on the racks.    No abatement certification or documentation is required for this item.

29 CFR 1910.147(c)(1): Energy control program. The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  On or about 8/7/2013, the employer had not implemented an energy control program at the facility for employees providing service and maintenance to equipment. 29 CFR 1910.151(c): Where the eyes or body of any person were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body was not provided within the work area for immediate emergency use.  On or about 8/7/2013, in the shipping area, the employer did not install an emergency eye wash at the forklift battery charging area. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.  On or about 8/7/2013, in the production area of the Pendergrass facility, employees were exposed to amputation hazards at various machines as the points of operations, moving/rotating parts at the machines were not guarded. Abated/Corrected during inspection 5 - 3/4" Pneumatic Punch Press Boggs (No serial #). Abated/Corrected during inspection 6 - Lantech packaging press (No serial #). Abated/Corrected during inspection 7 - 5/8" Assembly table (No serial #).
