OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On or about 8/7/2013, at the Pendergrass facility, employees were exposed to struck by hazards as the employer was not following standards set forth in ANSI MH16.1, 2008 Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks for metal shelving systems used in production and shipping departments. In July 2013 a racking system failed and collapsed in the production area. The employer had not regularly inspected the racks for damage and ensured all repairs or replacements were made to the racks as needed and did not display the load ratings on the racks. No abatement certification or documentation is required for this item.
