29 CFR 1910.272(j)(1): The employer did not develop and implement a written housekeeping program that established the frequency and the method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces: On 8/14/2013 in the canvas-topped building (known on site as the circus tent), there was a visible layering and buildup of grain dust on piles of wheat and corn, and on stored materials in the west end of the building. At least 1 inch of grain dust was observed as an accumulation on the east side of the corn pile. a.) The company's Housekeeping Program did not include timely inspections (e.g., after loading/unloading activities) or special controls that would have identified excessive accumulation of grain dust on pile surfaces. b.) The company's Housekeeping Program did not identify any method to prevent or clean-up grain dust on grain piles and other surfaces in this building, except for a reference to dry sweeping floor areas. This area was periodically used for open grain transfer including truck dumping and grain conveyor loading which creates dust clouds. The dust accumulations from the suspended dust can occur on multiple surfaces. Abatement Certification and Documentation is required.

29 CFR 1910.305(b)(2)(i): Each outlet box in completed installations did not have a cover, faceplate, or fixture canopy: a) On 8/14/2013 in the canvas-topped building (known on site as the circus tent) used for grain storage, the structure was equipped with a garage door and an electrical door opener that was connected to an interior plug-in outlet which was not equipped with a cover plate. There was visible dust within the outlet enclosure. The unprotected outlet would create the potential for contact with live parts whenever the plug was handled. Abatement Certification and Documentation is required.

29 CFR 1910.307(c)(2)(i): Equipment in hazardous (classified) location(s) was not approved for the ignitable or combustible properties of the specific gas, vapor, dust, or fiber that was or could be present: a) On and before 8/14/2013, in the canvas-topped building (known on site as the circus tent) used for grain storage, electrical wiring and equipment, including a garage door opener, were not approved for Class II, Division 1 or Division 2 locations. The facility included a layer of settled dust in quantities sufficient to produce explosive or ignitable mixtures on part of the corn grain pile and other surface areas. The building was used for open grain transfer including truck dumping and grain conveyor loading which generates dust clouds during that process. Abatement Certification and Documentation is required.
