OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to: a) Russo Heating & Cooling, Inc. / 225 West 10th Street, Erie, PA Portable Metal Ladder/Lower Roof Area: On or about August 15, 2013, employees were potentially exposed to fall hazards from portable metal ladders which were not placed/set-up properly and not being utilized in accordance with manufacturers instructions. Employees were utilizing a portable metal ladder to access the roof of the building. The ladder did not extend 3-feet vertically past the roof line.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: a) Russo Heating & Cooling, Inc / 225 West 10th Street, Erie, PA: On or about August 15, 2013 employees were installing new HVAC units on the roof on the footprint of the old units. Employees were working on a flat roof approximately 23 feet from ground level. The employee was not protected from falling by guardrails and/or equivalent protection. IN THE ALTERNATIVE: 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered. a) Russo Heating & Cooling, Inc / 225 West 10th Street, Erie, PA: On or about August 15, 2013 employees were installing new HVAC units on the roof on the footprint of the old units. Employees were working on a flat roof approximately 23 feet from gorund level. The employees were not wearing and/or utilizing a personal fall arrest system (PFAS) while performing the activities related to HVAC installation.
