29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented. On or about August 12, 2013, employees were framing the decks of the residential apartment complex under construction up to approximately 18 feet high without fall protection, exposing employees to a fall hazard.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access: On or about August 12, 2013, an employee was framing the deck to the residential project under construction up to approximately 18 feet high using an extension ladder to access the decking and the ladder did not extend at least 3 feet above the upper landing surface, exposing the employee to a fall hazard.
