29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   The employer did not institute a hearing conservation program for employees exposed to noise at an eight hour time weighted average of more than 85 decibels. This violation occurred on or about August 13, 2013, in the hammer hog area where an employee was exposed to an eight our time weighted average of 95.5 decibels before an effective hearing conservation program had been implemented.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an effective hearing conservation program, as described in 29 CFR 1910.95(c) through (o), is implemented and maintained.

This violation occurred on or about August 13, 2013, and at times prior thereto, when an employee in the facility was required to operate forklifts while moving material without having been trained and evaluated to ensure he could do so safely.
