29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to recognize, control and/or eliminate any hazard(s) or other exposure to illness or injury. Location: 445 Gold Street, Brooklyn, NY On or About September 20, 2013, (a)The employer did not train the employee on the hazards of working/walking in close proximity of earth moving equipment. Employee was walking and approached the machine from the rear, when he was crushed under the track of the excavator. BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
